#TheMbenengeMatter – Identifying the Complainant

The complainant in the allegations of sexual harassment against Judge-President Mbenenge was identified from the first media report – in the Sunday Times – as Andiswa Mengo, an official in the Makhanda high court.

The complainant has never withheld her identity from the public, nor sought anonymity. The gist of some of her claims against Mbenenge have been the subject of her own social media posts on her verified platforms.

However, some media reports have continued to protect her identity, presumably following the South African press code which prohibits disclosing the identity of a victim of sexual violence and harassment without the victim’s consent.

In its ruling on the complaint, the Judicial Conduct Committee referred to the complainant as AM.
